Terms of use
1. Provider and scope
The provider of ImmoCockpit is Nick Seidenberg, Friedrich-Miethe-Weg 10, 50259 Pulheim, Germany (see legal notice). These terms apply to the use of the web application at immocockpit.eu.
2. Service
The tool supports the management and analysis of properties (incl. rent management, reminders, rent increases, service charge statements, loans, cash flow, valuation, energy & renovation, tax overviews, document storage, AI functions). The “Start” plan (1 property) is free of charge; for paid services (“Portfolio” plan, storage packs, AI credits) our T&Cs with cancellation policy also apply. There is no entitlement to specific functions or a specific availability; we strive for trouble-free operation. Functions may be further developed, changed or discontinued; we will inform you of significant changes by email in good time.
3. No legal, tax or financial advice
All calculations (e.g. scope for rent increases, rent increase cap, rent brake, depreciation, tax and cash flow forecasts, valuations), templates (reminders, rent increase requests, leases, operating cost statements) and AI texts are non-binding aids. They do not replace advice from lawyers, tax advisers or financial advisers. You check results and letters yourself before use and are responsible for their content and sending. English letters are convenience translations; for German tenancies, German-language letters are recommended.
4. Account and obligations
- You must be of legal age and provide truthful information. You keep your credentials secret; if you suspect misuse, you change your password and inform us.
- You only upload content that you are entitled to process, in particular your tenants’ personal data only within the framework of the GDPR.
- The tool is intended for managing your own properties or properties you look after. Automated mass queries, attacks on security and use for unlawful purposes are prohibited.
- You use AI functions via the ImmoCockpit AI within your AI credits (see T&Cs). We may limit usage in the event of misuse (e.g. automated mass requests). AI results may be incorrect and must be checked before use.
- For AI functions with your own API key, the respective provider’s terms (Anthropic or OpenAI) also apply; you bear the costs directly vis-à-vis the provider.
- With read-only access you give third parties (e.g. bank or tax advisers) insight into your data. You decide what is shared and are responsible for ensuring that the disclosure – in particular of tenant data – is permissible (e.g. by using the option “Anonymise tenants”). You only pass an access link on to the intended person.
- For the optional bank retrieval you use your own access at Enable Banking; its terms apply. Bank retrieval is a beta function without guarantee of the completeness of the retrieved transactions.
5. Backups
We back up the data daily. Independently of this, we recommend regularly downloading an export (Account → “Export all data”).
6. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. In the case of simple negligence, we are only liable for breach of essential contractual obligations and limited to the foreseeable, typical damage. For free use: liability only for intent and gross negligence (§§ 521, 599 BGB by analogy).
7. Term and termination
You can delete your account yourself at any time (Account → “Delete account permanently”). We may terminate the contract with 4 weeks’ notice and block it without notice in serious cases (e.g. attacks, unlawful content). If we terminate, you will have sufficient time to export your data.
8. Data processing (Art. 28 GDPR)
Insofar as you process personal data of third parties in the tool (in particular tenants, contacts), you are the controller and we are your processor. The following applies:
- Subject matter and duration: storage and processing of the data you record to provide the tool, for the duration of the user relationship.
- Type of data / data subjects: contact, contract and payment data of tenants, contact persons and other third parties you record.
- Instructions: we only process the data on your instructions, which are given through your use of the tool, and not for our own purposes.
- Confidentiality: persons with access to the systems are bound to confidentiality.
- Technical and organisational measures: TLS encryption, encryption of content per account, hashed passwords, optional 2-factor sign-in, limitation of sign-in attempts, server access by key only, daily backups, data centre in Germany.
- Sub-processors: Hetzner Online GmbH, Gunzenhausen (hosting, data centre Nuremberg); STRATO GmbH, Berlin (email sending); OpenAI Ireland Ltd., Dublin (ImmoCockpit AI, only when an AI function is used; processing also possible in the USA, standard contractual clauses/Data Privacy Framework); Stripe Payments Europe Ltd., Dublin (payment processing, no content data). We will inform you of changes in advance; you can object and delete your account.
- Support: we support you with data subject requests (export function) and inform you without delay of data breaches.
- Deletion: after the end of the contract all data will be deleted (see privacy policy, retention period).
- Audit: on request we provide the information necessary for verification.
9. Changes to these terms
We will notify you of changes by email at least 4 weeks in advance. If you do not object within this period, they are deemed accepted; we will point out this consequence in the notification. If you object, you can delete your account.
10. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of your country of residence remain unaffected. Only the German version of these terms is legally binding.
